Legal
Terms and conditions
These terms govern your use of Omega Writer. Take your time reading them: by creating an account or using the service, you agree to comply with them.
1. Who we are
Omega Writer is a service operated by Compucas Software Corp. (“we”), a company with its registered address at Centro Comercial Camino de Cruces, Avenida Miguel Brostella, Panama City, Republic of Panama. When you use Omega Writer, your contract is with Compucas Software Corp.
You can write to us at info@omegawriter.app.
2. Acceptance
By signing up, purchasing a plan or continuing to use the service, you accept these terms, our privacy policy and our refund policy. If you use Omega Writer on behalf of an institution or company, you represent that you have the authority to accept them on its behalf.
You must be of legal age and have the legal capacity to enter into contracts.
3. The service
Omega Writer transcribes audio and video and lets you work with the transcript:
- Upload files of up to 2 GB or paste shared links from Google Drive, Dropbox, OneDrive and SharePoint, including shared Teams recordings.
- Get the transcript with speakers and, if you choose, timestamps, and download it as TXT or Word.
- Automatically get a summary and a topic index of each recording, and search across all your transcripts.
- Ask questions about one recording or several in a project at once, with citations to the exact moment, and create documents (minutes, summaries, action plans, slide decks and others) in Word, PDF, Excel, CSV, PowerPoint, HTML or Markdown.
- Save your own or your organization’s templates and set up automations that create documents when a transcription finishes.
- Share audio files and documents through public links, or send documents by email.
To provide the service, we use transcription and artificial intelligence model providers that process your content on our behalf.
4. Accounts and organizations
- You are responsible for keeping your password secret and for the activity that occurs in your account. Let us know immediately if you suspect unauthorized access.
- Each account belongs to an organization. The hours balance belongs to the organization and is shared by its members.
- The owner of the organization manages the plan, the payments and the members. Each member sees their own audio files; the owner sees all of the organization's audio files.
- The Institutional plan allows up to 5 users. The other plans are for 1 user.
5. Plans, hours and payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
Paddle handles customer service inquiries about payments and processes refunds.
Plans and renewal
- Plans are billed in advance, monthly or yearly, and renew automatically at the end of each period until you cancel them.
- Prices are in US dollars. Paddle calculates and collects any applicable taxes based on your country, and issues the invoice.
- When you move to a plan with more hours, the prorated difference is charged at that time and the additional hours are credited immediately. When you move to a plan with fewer hours, the new price applies from the next renewal.
- If we change our prices, we will notify you by email at least 30 days in advance, before the new price applies to your next renewal.
How hours are used
- Each plan credits a number of audio hours per period. Each audio file deducts its actual length from the organization's balance. Before you upload an audio file, we tell you whether the balance is enough.
- Each audio file includes 30 questions and 10 documents created with the included model. Premium models and any use beyond that quota deduct from your balance, and we show you the cost before running them.
- New accounts receive 3 trial hours with no card required.
- You can buy top-ups of 10 hours for US$15 each, without changing your plan.
- Hours you don't use in a period are added to your balance and remain available as long as the account is active. This includes top-up hours.
Cancellation
You can cancel your plan at any time from Plan and payments. The plan stays active until the end of the paid period and does not renew; you don't lose your remaining hours by canceling. For refunds, see the refund policy.
6. Acceptable use
You may not use Omega Writer for:
- Illegal activities, fraud, spam or identity impersonation.
- Uploading recordings obtained without the consent or authorization required by law, or content you don't have rights to.
- Infringing other people's intellectual property, image or privacy rights.
- Creating or spreading non-consensual sexual content, deepfakes, hate speech, harassment or threats, or publishing third parties' personal data (doxxing).
- Deceiving other people by passing off the results as something they are not.
- Attempting to get around the limits or safeguards of the service or of the artificial intelligence models (jailbreaking).
- Interfering with the security of the service: distributing malware, probing or attacking systems, extracting data automatically (scraping) or accessing other people's accounts.
- Reselling or redistributing the service without a written agreement with us.
We may review content reported as abusive, remove it and suspend accounts that break these rules.
7. Your content and our intellectual property
- Your content is yours. You keep the rights to the audio, video and links you upload and to the transcripts, answers and documents you create.
- You give us permission to store, process and transmit that content only to the extent necessary to provide the service to you.
- You are responsible for having the rights and authorizations for the content you upload, including the consent of the people recorded when the law requires it.
- We retain ownership of Omega Writer, its software, its brand and its logo. These terms do not grant you any rights to them beyond using the service.
Intellectual property claims
If you believe that content hosted on Omega Writer infringes your rights, write to us at info@omegawriter.app with the subject line “Intellectual property.” Identify the content, the link if you have it and the right affected. We will review the claim and, if appropriate, remove the content. We will close accounts that repeatedly infringe rights.
8. Accuracy of the results
Transcripts, answers and documents are created with artificial intelligence and may contain errors or omissions: misspelled names, mixed-up speakers or incomplete summaries. Review them before you use or circulate them.
The results are not legal, medical, financial or any other kind of regulated professional advice. Do not use them for those purposes without review by a qualified person. You decide how to use the results and you are responsible for that use.
9. Public links and emailed documents
When you create a public link, anyone who has it can see what it includes, without logging in. You can protect it with a password, set an expiration date and revoke it whenever you want. You are responsible for who you share it with.
When you send a document by email, directly or through an automation, the addresses you enter receive it as an attachment, and their replies come to you. You are responsible for having the right to share that content with those people. To prevent abuse, we limit sending (up to 5 recipients per message and 30 messages a day) and keep a record of each one.
10. Third-party integrations
You can connect your Microsoft account to transcribe files from OneDrive, SharePoint and Teams. Omega Writer only asks for permission to read your profile and the files you have access to, and only downloads the ones you choose. You can disconnect the account at any time from your profile. Your use of those services is also governed by their providers' terms.
11. Service availability
We work to keep Omega Writer available and working well, but we do not guarantee that the service will be uninterrupted or error-free. We may carry out maintenance and change or remove features, and we will notify you in advance of important changes when possible.
12. Suspension and termination
We may suspend or close an account, with notice when reasonable, if:
- it breaches these terms seriously or repeatedly;
- an outstanding charge is not paid;
- there is a security or fraud risk; or
- the law or a competent authority requires us to.
You can stop using the service whenever you want and ask us to delete your account by writing to info@omegawriter.app. Before you do, download anything you want to keep.
13. Limitation of liability
To the extent permitted by law, the service is provided “as is.” We are not liable for indirect damages, lost profits or loss of data arising from the use of the service. Our total liability to you will not exceed the amount you paid for Omega Writer in the 12 months before the event giving rise to it. Nothing in these terms limits the rights the law grants you as a consumer that cannot be waived.
14. Changes to these terms
We may update these terms. If the change is important, we will notify you by email or within the application at least 30 days before it takes effect. If you continue using the service afterward, you accept the new version.
15. Governing law and dispute resolution
These terms are governed by the laws of the Republic of Panama.
If a disagreement arises, write to us first at info@omegawriter.app: we will try to resolve it in good faith within 30 days. If it is not resolved, the dispute will be submitted to the courts of Panama City.
If you contract as a consumer, you keep the protection of the mandatory rules of your country of residence and may go to its courts when that law allows you to.
16. Language
These terms are published in Spanish, English, Portuguese and French. This document is a translation. If there are differences between the versions, the Spanish version prevails.
